Terms of Service

These terms are a binding agreement between you and Ellment Creative LLC ("Ellment Creative", "we", "us") for AILE and the AILE website and waitlist.
1. Acceptance and eligibility
By joining the waitlist or using AILE, you agree to these terms and to our Privacy Policy. You must be at least 13 years old. If you are under 18, you may use AILE only with the involvement and consent of a parent or legal guardian. If you do not agree, please do not use the service.
2. The service
AILE is a learning product that teaches everyday people how to use AI through short, gamified lessons. Today the service is pre-launch: you can join a waitlist to be notified and invited. Features, content, and availability may change, and we may add, modify, or discontinue parts of the service over time.
3. Acceptable use
You agree not to:
- break the law or infringe anyone's rights using the service;
- scrape, crawl, or harvest data, or access the service by automated means except as we expressly permit;
- probe, scan, or test the security of the service, or bypass any access control, except under our security policy;
- reverse engineer, copy, or create derivative works from the service except where the law forbids that restriction;
- upload malware, spam, or content that is unlawful, harmful, or infringing; or
- interfere with or disrupt the service or other users.
4. Accounts and security
You are responsible for keeping your account credentials confidential and for activity under your account. Tell us promptly at ellmentcreative@gmail.com if you suspect unauthorized use.
5. Intellectual property
Ellment Creative owns AILE, including its software, lessons, designs, text, graphics, the crystal mascot, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for your own personal, non-commercial learning, subject to these terms. All rights not expressly granted are reserved.
6. Your content
If the service later lets you submit content (for example, posts or progress you choose to share), you keep ownership of it and grant us a worldwide, royalty-free license to host and display it solely to operate the service. You are responsible for content you submit and must have the rights to share it. A full content and community policy will apply when those features launch.
7. AI features and no professional advice
AILE uses AI to generate and review learning material. AI output can be inaccurate, incomplete, or out of date. The service is for general education only and is not professional advice (legal, financial, medical, or otherwise). We make no guarantee of any particular learning outcome, result, or career benefit. Always use your own judgment and verify important information.
8. Subscriptions and billing (when launched)
AILE plans to offer a paid subscription. When billing launches, we will present the price, billing interval, and renewal terms before you pay. Where required by law, subscriptions that renew automatically will include clear disclosure of the renewal, a reminder where mandated, and an easy way to cancel. These terms will be supplemented by subscription-specific terms at that time.
9. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Ellment Creative and its owners and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100. Nothing in these terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold Ellment Creative harmless from claims and expenses arising out of your misuse of the service or your breach of these terms, to the extent permitted by law.
12. Governing law and disputes
These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-laws rules. Subject to the optional arbitration clause below, you and Ellment Creative agree to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota.
Optional, to be confirmed by counsel: the parties may agree to resolve disputes through binding individual arbitration and to waive class actions and jury trials. This clause is included as a placeholder; it is not in effect until finalized and clearly presented.
13. Termination, changes, and miscellaneous
We may suspend or end access that violates these terms. We may update these terms; for material changes we will give notice and update the “Last updated” date, and continued use means acceptance. If any provision is unenforceable, the rest stays in effect. These terms are the entire agreement between you and Ellment Creative regarding the service.
